 Lewis and Clark Villages Rental Agreement

PARTIES AGREE THAT each of the terms of this Agreement as well as the University of Montana policies listed in the Current Handbook and UM Student Conduct Codes are conditions on TENANT’S right to occupy the Premises. Any failure by TENANT to comply with one or more of such terms is a default under this Agreement. In the event of such a default, Residence Life Office may at its option, terminate this Agreement, evict TENANT and seek any other remedy permissible under Montana Law, including but not limited to The University of Montana Student Conduct Code. Montana Residential Landlord and Tenant Laws do not apply to housing provided by the Montana University system.

PARTIES FURTHER AGREE TO THE FOLLOWING TERMS:

1. Rental of the premises shall be from___________________, 20_____ through date specified on the 60 day vacate notice.

2. The monthly rent for the premises that TENANT shall pay to The University of Montana is $380.00. All rent payments are
due in advance by the first day of each month. Failure to remit payment in full by the 1st of each month will result in their student account being assessed a $25.00 Late Fee for payments not received. If you have selected the semester rent payment method, the semester rent must be paid by the 1st class day or a $25.00 late fee will be assessed.

3. In the event TENANT fails to pay any rent or other charges owed to The University of Montana under this Agreement, The University of Montana may, in addition to any other remedy, refer to the Montana Department of Revenue and/or private collection agency for collection from TENANT. TENANT will then become liable for all costs incurred by The University of Montana, the Montana Department of Revenue and/or the collection agency in the collection of such charges. In addition, The University of Montana shall have the right to deny TENANT’s access to future University of Montana registrations and records until all monies owed by TENANT are paid in full. The University of Montana may also file University of Montana Student Conduct Code charges against TENANT in the event of any nonpayment.

4. TENANT shall not bring, keep or maintain any pet(s) on the Premises. This includes pets belonging to visitors. Pets will not be permitted to “visit” or be on the premises for any reason. Violation of this policy will result in eviction procedures being implemented and the TENANT will be given 30 days to vacate premises. The entire damage deposit will be automatically forfeited if a pet is found on the premises. Additionally, any damages incurred above the deposit will be billed to your student account.

5. TENANT shall not transfer possession of the Premises without the express written permission of The Lewis and Clark Village Office.

6. Notice of Intent to Vacate” form at least sixty (60) days prior to the date TENANT plans to vacate the Premises. TENANT is liable for sixty (60) days rent from the day Lewis and Clark Village receives this “Notice to Intent to Vacate.”

7. Renting a steam cleaner will NOT be permitted to clean the carpets. If the carpets are not clean, Lewis and Clark Village Office will make arrangements for cleaning and charge the expense back to the tenant.

8. Lewis and Clark Village Office further reserves the right to terminate this Agreement and TENANT’S right to occupy the Premises, to the full extent permissible under Montana law if:
a. TENANT:
--is not currently enrolled in The University of Montana as a full time student
--as undergraduate with at least 10 credits per semester and completing at least 20 each calendar year
--as graduate with at least 6 credits per semester and completing at least 12 credits each calendar year
--occupancy exceeds six (6) consecutive years; or
b. TENANT or a guest of TENANT violates this Agreement, The University of Montana Student Conduct Codes or any of the policies and regulations.
c. TENANT has provided false or inaccurate information when applying for occupancy of the Premises; or
d. TENANT becomes delinquent in rent payments to The University of Montana.

9.. TENANT acknowledges receipt of the copy of the written statement describing the condition of the Premises to TENANT’S occupancy, the Lewis and Clark Village Handbook, all of which are hereby incorporated as part of this Agreement. TENANT shall deposit with Lewis and Clark Village a Security Deposit in the sum of $_300.00 to secure TENANT’s compliance with all the conditions of this Agreement. TENANT will forfeit all, or portions, of this deposit if any of the following events occur:

a. if TENANT vacates the Premises with unpaid rent still owing to Lewis and Clark Village; or
b. if TENANT vacates the Premises leaving the Premises in a damaged state or needing substantial cleaning.

10. Upon termination of the tenancy, TENANT shall return the premises to Lewis and Clark Village Office in as good order, condition and repair as when received; ordinary wear and tear excepted, and free of all TENANT’S personal property, trash and debris.

11. Within thirty (30) days after TENANT vacates the Premises, Lewis and Clark Village will deliver to TENANT a written list of any deductions from the Security Deposit and payment of the balance due to TENANT. This list and payment will be sent to TENANT’S new address provided TENANT advises Lewis and Clark Village Office in writing, prior to moving, of this new address. If the Security Deposit is insufficient to satisfy the damages, cleaning charges or unpaid rent, The University of Montana may collect any deficiency from TENANT and take proper legal action to recover such deficiency as stated in Paragraph Three (3) of the Agreement.


12. TENANT shall allow The University of Montana to enter the Premises for reasons of safety and security, health inspections, preventative maintenance inspection, pest control, improvements or repairs. Except in the case of emergency, or unless it is impractical to do so, Lewis and Clark Village Office shall give TENANT twenty-four (24) hour written notice of its intent to enter and will enter only at reasonable times. If The University of Montana personnel must enter the Premises when TENANT is not present, a written notice will be left inside the Premises indicating who was there and the purpose of the entry.

13. TENANT shall not make any alterations, additions or repairs on the Premises. For Life Safety reasons the use of halogen lamps, candles and incenses, and smoking is prohibited in the apartments.

14. TENANT shall not establish a business within the Premises.

15. TENANT’s vehicle must be registered with The University of Montana and display a Lewis and Clark Village parking decal, and all vehicles must be maintained in operable condition and licensed for the current year. (Parking Lots are restricted to registered tenant parking only).

16. The University of Montana shall not be liable to TENANT or insure TENANT for any personal injury or property damage caused by the act or omission of any other TENANT or of third parties. TENANT shall obtain and pay for any insurance coverage that TENANT deems necessary to protect TENANT and TENANT’S property.

17. Lewis and Clark Village Office reserves the right to change the rental rate stated in this Agreement after giving TENANT at least 30 days prior written notice.

18. TENANT is responsible for filling out and returning the Inventory Check In Sheet to the Lewis and Clark Office within seven days of move in. If the Inventory Check In Sheet is not return on a timely basis, the tenant will be responsible for any damages found in the apartment.

19. Failure of The University of Montana to enforce any of the terms of this Agreement shall not be construed as a waiver of any of such terms. The terms shall remain in full force and effect throughout the period of TENANT’S occupancy of the Premises. The University of Montana reserves the right to develop other rules and regulations as necessary for the safety, care and cleanliness of the premises and for the security, comfort and convenience of all occupants. Montana Residential Landlord and Tenant Laws do not apply to housing provided by the Montana University System
