DUI Laws and Consequences

1st Offense

  • Jail time.
  • Fined $300 to $1000.
  • Complete and pay* for a community-based substance abuse information course approved by DPHHS, or court, or provided by Dept. of Corrections, or licensed hospital chemical dependency program.
    *usually costs between $65 to $250
  • 6-month Driver's License suspension.

2nd Offense

  • Jail time.
  • Fined $600 to $1000.
  • Complete and pay* for a community-based substance abuse information course approved by DPHHS, or court, or provided by Dept. of Corrections, or licensed hospital chemical dependency program.
    *usually costs between $65 and $250
  • 6-month Driver's License suspension.

3rd Offense

  • Jail time.
  • Fined $1000 to $5000.
  • Complete and pay* for a community-based substance abuse information course approved by DPHHS, or court, or provided by Dept. of Corrections, or licensed hospital chemical dependency program.
    *usually costs between $65 and $250
  • 1-year Driver's License suspension.
