MIP Laws and Consequences

1st Offense

  • Fined $100 to $300.
  • 20 hours of community service.
  • Complete and pay* for a community-based substance abuse information course approved by DPHHS, or court, or provided by Dept. of Corrections, or licensed hospital chemical dependency program.
    *usually costs between $65 and $100
2nd Offense
  • Fined $200 to $600.
  • 40 hours of community service.
  • Complete and pay* for a community-based substance abuse information course approved by DPHHS, or court, or provided by Dept. of Corrections, or licensed hospital chemical dependency program.
    *usually costs $250
  • Complete chemical dependency assessment/treatment if recommended.

3rd Offense

  • Fined $300 to $900.
  • 60 hours of community service.
  • Complete and pay* for a community-based substance abuse information course approved by DPHHS, or court, or provided by Dept. of Corrections, or licensed hospital chemical dependency program.
    *usually costs $250
  • Complete chemical dependency assessment/treatment if recommended.
  • Possible jail time of up to 6 months.
