The University of Montana - Missoula campus and area hotels and caterers in negotiation through the Missoula Chamber of Commerce have established a First Right of Refusal agreement that states:
University Catering Services will not compete with community businesses for non-University related business off campus and in return community hotels and caterers will not provide service on The University of Montana - Missoula campus.
The University of Montana retains the sole right to provide food service or exercise its First Right of Refusal at all University properties. These properties include:
The above agreement is consistent with and is supported by The University of Montana Facilities Rental and Use Policy 80.0 which states: University Dining Services has the Right of First Refusal to provide all food and beverages on campus.

Organizations or individuals requiring food or beverage service in any facility at The University of Montana may not sell or serve food or beverage that is provided by commercial or domestic sources without approval of the Catering Manager, Director of Environmental Health and Manager of the Facility. Only if the event requires some food or beverage service that cannot be reasonably provided by a University Dining Services venue will consideration be given to extend our First Right of Refusal.
In some instance the client does not want to utilize the services available even though they can be reasonably provided by a University Dining Services venue. In those circumstances, UDS will negotiate a Lost Revenue Fee prior to extending a First Right of Refusal. Consideration will be given on a case by case basis. University Dining Services will extend a First Right of Refusal only under the following circumstances:

THIS POLICY APPLIES TO ANY GROUP WISHING TO USE A CAMPUS FACILITY AND INTENDING TO SERVE FOOD FOR THEIR FUNDRAISING EVENT.
In specific instances, a client may request that University Dining Services grant a Right of First Refusal allowing an outside entity to provide food service on campus. Specific policies and regulations (both The University of Montana and Missoula CIty County Health Department) must be followed to limit University liability. University Dining Services reserves the right to mandate what circumstances and/or events fall into this category.
Consideration will be given on a case-by-case basis. In some cases, a flat Lost Revenue Fee will be levied by University Dining Services. In all cases, University Dining Services will provide a signed First Right of Refusal Form when it exercises its First Right of Refusal.
If granted a First Right of Refusal, the client must do the following:

MUST BE A UNIVERSITY EVENT OR UNIVERSITY RECOGNIZED GROUP
All bake sales must be scheduled through the Event Planning Office located in the University Center (406) 243-4114. The sponsor must complete a "Request for Bake Sale Waiver Non-Profit Organization Temporary Food Service Establishment" form available from the Missoula City-County Health Department and submit it to the Event Planning Office prior to the event.
Food for public consumption must meet all Missoula City-County Health Department requirements.
All displayed baked food items must be either individually pre-wrapped with clear plastic or covered throughout the bake sale. Tongs, plastic gloves, or other appropriate barrier must be used to dispense food.
Approved bake sale items include cookies; cakes, breads, fruit pies, and pastries that are not filled with dairy products and that do not require refrigeration.
The sale of ANY potentially hazardous food is prohibited at bake sales. Potentially hazardous foods include pie with dairy products or eggs, such as pumpkin or lemon meringue pies, cheesecakes, meat-filled pastries or non-dairy cream fillings and high protein foods.
Sandwiches of any kind are prohibited.

MUST BE A UNIVERSITY AFFILIATED GROUPS SUCH AS STUDENTS, FACULTY AND STAFF.
Potlucks are for social gatherings and not for fundraising purposes. Potluck participants may not be charged a fee. If you intend to charge a fee, please refer to the Fundraiser portion of this policy.
Potlucks held in the University Center must be scheduled through the Event Planning Office.
Potlucks may not be held in areas accessible to the public and must be confined to a specific area.
Participation must be restricted to members, spouses, families and/or guests of The University of Montana affiliated group.
Alcoholic beverages are prohibited.
Participants may furnish their own service ware (i.e., plates, silverware, utensils, paper goods, cups, napkins, etc.), or rent or purchase service ware from University Catering Services at a very competitive price. Please call the Catering Office (406) 243-4899 for details and availability.
Sponsoring groups may not advertise the potluck publicly. Notification is limited to word of mouth only.
Sponsor is responsible for the safety and wholesomeness of the food served, subject to the published "Guidelines for a Safe Event Involving Food" published by the Missoula City / County Health Department (available separately).

THIS POLICY APPLIES TO UNIVERSITY GROUPS WISHING TO SERVE DONATED FOOD OR BEVERAGE AT A CAMPUS FACILITY
The University of Montana retains the sole right to provide all food and beverage service on campus. Any University event offering donated food or beverages must be planned in conjunction with University Catering Services and will be considered a catered event.
If you are planning serve donated food or beverages the product must be provided by a licensed vendor. The licensed vendor must provide donated food or beverage without charge to the client. The client must provide documentation of the donation from the licensed vendor to University Catering Services. The client is also responsible for delivery of donated products to University Catering Services. University Catering Services will be responsible for all handling, storage, delivery, and service of donated product. University Catering Services will charge appropriate fees for the handling, storage, delivery, and service of donated products.
Any food or beverage must meet all applicable federal, state, and local codes pertaining to the service of food and beverage for public consumption.
A list of donated products must be provided to the University Catering Office on the Donated Food Form, which is available at the University Catering Services office.
The client must provide a sign indicating that food products are donated and by whom. University Catering Services will prominently display the sign at your event.
University Catering Services will only pass on to the client those costs associated with providing this service. The cost of preparing and setting up donated product will be calculated at $10.64/hour for kitchen production time and $8.05/hour for service time. An estimated prep and service time can be determined after University Catering Services is provided a list of the donated products. This list must include the condition in which the donated product will arrive to University Catering Services along with the expectation of service of donated products.
Service table linens, paper or china service, and a variety of other equipment can be provided for an additional fee.

Must meet one of the following criteria:
Must be...
An academic or campus-related event sponsored by a University department, ASUM, ASUM registered group, or an affiliate of the University including UM Foundation, Grizzly Athletic Association, Heart Institute, etc.; or,
A private event, sponsored by individual staff, faculty, or students; or,
Sponsored by public schools, other educational institutions, state/federal agencies/offices and athletic events; or,
Directly related to the possible recruitment of future students: e.g. band days, high school graduation parties, etc.
Size, date, or setup requirements cannot be met by the private sector, documented in writing.
Events that are planned in cooperation with the community, private sector, and/or Chamber of Commerce when it is mutually beneficial to all parties to use University Catering Services
